Who can apply for an Industrial Designs in Brunei Darussalam?
Any individual or legal entity, including companies, universities, and research institutions, may apply for an Industrial Design.
What happens if my invention is publicly disclosed before filing an Industrial Designs application?
In general, public disclosure may affect the novelty of an invention. However, under the Industrial Designs Order, an applicant is allowed a 12-month grace period from the date of public disclosure to file a patent application in Brunei Darussalam. After this period, the invention may no longer be considered new and may not be patentable.
What counts as public disclosure?
Public disclosure includes, but is not limited to, publications, presentations, exhibitions, online postings, sales, or any other act that makes the invention available to the public.
Where can I search for Designs which has been registered in Brunei?
You can request for search on registered Design at our BruIPO Office using our database. You can also check design that are registered from other countries using BruIPO database.
Can I transfer my registered design to someone else or license it out?
Yes. The same with other IP, a registered design is a right that can be assigned or licensed to another party.
