What is GI?

WHAT IS A GEOGRAPHICAL INDICATION?

Geographical Indication refers to a sign used to identify a product that originates from a specific country or region, or a particular area or locality within that country or region, where a quality, reputation or other characteristics of the product is essentially linked to its geographical origin.

HOW IS GEOGRAPHICAL INDICATION PROTECTED?
  • Brunei Darussalam is working towards establishing a Sui Generis system.
  • Currently, geographical indications are protected under the Trade Marks Act, 2022.
    WHAT PRODUCTS CAN BE IDENTIFIED BY GEOGRAPHICAL INDICATION?
    • Foodstuff
    • Agricultural products
    • Handicrafts
    • Industrial products

    Examples of well-known GIs globally include Parmigiano Reggiano (Italy), Kampot Pepper (Cambodia), Musang King Durian (Malaysia).

    BENEFITS OF A GEOGRAPHICAL INDICATION

    Registration of a Geographical Indication provides the following benefits:

    • It prevents the unauthorized use of geographical names by other parties.
    • The authenticity and quality of the product is guaranteed as the products must meet specific standards.
    • By recognising the link between a product and its place of origin, Geographical Indications promote the preservation of traditional production practices and prevent the misuse of a region’s cultural identity by unauthorised parties.
    • Products protected as Geographical Indications benefit from increased recognition and value.
    • It boosts the local economy
            TERM OF PROTECTION

            GI registration is valid for 10 years from the date of filing of the application. This may be renewed for another 10 years subject to the payment of the renewal fee.

            WHO MAY APPLY?
            • A person who is carrying on an activity as a producer in the geographical area specified in the application
            • A trade organization or association
            • A competent authority
